Declaration
In a Homeowners Association (HOA), a Declaration (most commonly known as the Declaration of Covenants, Conditions, and Restrictions or CC&Rs) is the foundational legal document that establishes the rules, rights, and responsibilities of both the association and the individual property owners.
Code of Regulations (Bylaws)
An HOA’s Code of Regulations serves as the operational blueprint for the association.
While other governing documents dictate what homeowners can and cannot do with their properties, the Code of Regulations dictates how the HOA itself operates as a non-profit corporation.
